Terms of use of the StudentSpace website

INFORMATION ABOUT THE WEBSITE AND THE TERMS OF ITS USE

  1. These Terms of Use set out the rules for free use of the website called StudentSpace available at studentspace.pl by individual users.

  2. The owner of StudentSpace website authorised to use its resources is SGE Operating Company sp. z o.o. with its registered office in Warsaw, ul. Litewska 1, 00-581 Warsaw (hereinafter referred to as the ‘Website Owner’).

DEFININITIONS

  1. StudentSpace - SGE OPERATING COMPANY sp. z o.o. with its registered office in Warsaw (ul. Litewska 1, 00-581 Warsaw), entered into the Register of Entrepreneurs of the National Court Register, for which registration files are kept by the District Court for the Capital City of Warsaw in Warsaw, XII Business Division, under KRS number 0001031019, REGON: 525057433, NIP: 7011139662, share capital: PLN 322,750.00.

  2. Terms of Use – these Terms of Use.

  3. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

  4. Website – website operated by the Owner of the Website, available at: www.studentspace.pl.

  5. User – any natural person visiting the Website or using one or more of the services or functionalities described in the Terms of Use.

GENERAL TERMS OF USING THE SERVICE

  1. The Website serves information purposes, presenting the Website Owner's offer and making materials available, in particular materials related to rental of rooms in the student dormitories managed by the Website Owner

  2. The Terms of Use define the type and scope of services provided electronically on the Website, as well as the conditions for conclusion and termination of agreements and the principles for use of the Website by Users, as well as the principles for use of its additional functionalities.

  3. The Agreement for the provision of the Service of access to the Website isconcluded under the Terms of Use, for an indefinite period of time, when the User effectively calls up the URL of the Website in the browser window of the User's device, or when the User uses the redirection leading to the Website (i.e. when visiting the Website); in this case, the Agreement for provision of the Service of access to the Website is terminated when the User leaves the Website.

  4. The use of the Website is possible on condition that the ICT system used by the User meets the following minimum technical requirements:

    4.1

    an internet-connected device with an installed and ready-to-go web browser supporting HTML5 and PDF;

    4.2

    enabling cookies and javascript in the browser;

  5. The recommended screen resolution for displaying the Website is 1280 pixels.

  6. No fees are charged or collected for the use of the Website.

  7. The User is obliged to use the Website in accordance with the law and principles of morality, taking into account personal rights and intellectual property rights, in particular copyright, vested in the Website Owner or third parties.

  8. The User is entitled to use the Website solely for their own personal use. This means, in particular, that in relation to data and any other materials contained in the Website resources, both those which are protected under copyright law and those which are not, it is not permissible to use the aforementioned materials in order to carry out commercial activities by the User.

  9. The Website Owner represents that the materials and information published on the Website are collected and edited with due diligence. However, due to the specific nature of the services provided by the Website Owner, the Website Owner is not liable for the truthfulness, accuracy and factual accuracy of the information presented on the Website.

  10. The User is obliged not to undertake any actions which would affect correct functioning of the Website. In particular, it is forbidden to interfere in any way with the content posted on the Website.

  11. The provision of unlawful content by the User using the Website is prohibited.

COMPLAINT PROCEDURE

  1. In the event of concerns about the operation of the Website, the User may lodge a complaint in the manner of their choice, in particular by sending an email to: rodo@studentspace.pl

  2. All complaints, including those relating to the provision of electronic services, shall be dealt with immediately, within a period of no more than 14 calendar days from the date of lodging the complaint. The complainant shall receive a reply in the form of an e-mail sent to the e-mail address from which the complaint was sent.

PERSONAL DATA PROCESSING

  1. Personal data of Users using the services available through the Website is processed in accordance with the principles described in the Privacy Policy, available in the ‘Privacy Policy’ tab, to which a link is provided in the footer of the Website.

CHANGES OF THE TERMS OF USE

  1. The Website Owner is entitled to unilaterally amend these Terms of Use to the extent not individually agreed with the User for justified reasons. As a justifiable reason is considered, in particular, the occurrence of one of the following circumstances:

    1.1

    a change in generally applicable law in the Republic of Poland or its interpretation by courts or public administration authorities to the extent that such a change modifies the content of the Terms of Use or imposes an obligation on the Website Owner to modify the Website content in a specific manner;

    1.2

    introduction of new functionalities of the Website Owner to the Website or modification of their current scope - in this case a change to the content of the Terms of Use is acceptable in the scope concerning such new functionalities.

  2. The Website Owner shall inform the User by publishing on the Website at least:

    2.1

    the content of the proposed changes to the Terms of Use

    2.2

    the date of entry into force of the change

    2.3

    the uniform content of the Terms of Use as amended.

  3. A change to the Terms of Use shall not apply to agreements for the provision of services concluded before the effective date of implementing change to the Terms of Use. In case of such agreements, the provisions of the Terms of Use in force on the date of the User's intention to conclude such an agreement for the provision of services shall apply.

FINAL PROVISIONS

  1. The Terms of Use enter into force on 03.02.2025.

  2. In matters not regulated by the Terms of Use, relevant provisions of law shall apply.For the avoidance of doubt, it is assumed that none of provisions of the Terms of Use shall restrict the User's rights to which they are entitled under the provisions of the law in force in the territory of the Republic of Poland. In the event of existence of a provision of this nature, provisions of the applicable law shall apply unconditionally

  3. Disputes arising from the Terms of Use that cannot be resolved between the Users and the Website Owner amicably shall be settled by the competent common court.
